Terms of Service
The agreement between you and PassTraq for using the journal, analytics, AI coaching, trading workbench and everything else in the Service.
Effective August 15, 2026
In short
- You must be 18+, keep one accurate account, and keep your login safe.
- Starter is free forever; the workbench, market data and replay are on paid plans.
- Paid plans renew monthly through Stripe. Cancel anytime in Settings; you keep access to the end of the period, then drop to Starter with your data kept.
- You bring your own broker and market-data entitlement. Data is best-effort and for your use inside the product only.
- Live order routing (Quant, beta) sends real orders to your broker. Every order is yours; keep broker-side risk controls on.
- PassTraq is software, not a broker or adviser. AI output can be wrong and is not investment advice. No guarantee of passing a challenge or making money.
- You own your content; public profiles and mentor sharing are opt-in.
- Our liability is capped at what you paid us in the previous 12 months, to the extent the law allows.
This summary is for convenience only — the numbered sections below are the agreement.
1.Acceptance and eligibility
These Terms of Service (“Terms”) are an agreement between you and PassTraq(“we”, “us”) covering your use of the PassTraq website, apps, APIs and related services (together, the “Service”). By creating an account or using the Service you accept these Terms, our Privacy Policy, our Refund Policy and our Risk Disclosure. If you do not agree, do not use the Service.
To use the Service you must:
- be at least 18 years old and legally able to enter into a contract;
- keep one account per person, registered with accurate and current information;
- not be barred from using the Service under any law that applies to you.
If you use the Service on behalf of a company or another person, you confirm you have authority to bind them, and “you” includes them.
2.The Service
PassTraq is software for futures traders who run prop-firm challenges and funded accounts. Depending on your plan it includes:
- a trade journal with CSV import and export and broker sync;
- challenge and rule tracking against your prop firm’s limits, plus payout tracking;
- analytics and reports on your trading;
- AI coaching (“Finia”) that reads your trades and journal and writes feedback;
- a trading workbench with charts, a depth-of-market ladder and simulated (paper) order execution;
- historical market replay;
- a strategy builder with backtesting, and a code editor on some plans;
- optional public profiles and a leaderboard, and mentor spaces you can share with people you invite.
Features vary by plan and some are marked beta. We may add, change or remove features over time (see Beta features and availability).
3.Accounts and security
You are responsible for everything that happens under your account. Keep your password private, use a strong one, and do not share your login. If you believe your account or any credential stored in it has been compromised, email [email protected] right away.
We may need to contact you about your account, so keep your email address current. Account emails come from [email protected].
4.Plans and billing
Starter is free forever: one account, CSV import and export, the journal, the rules dashboard and base analytics. It does not include AI features, the trading workbench, market data or replay — those are available on paid subscriptions only. Every new signup starts on Starter.
Paid plans (Trader, Pro and Quant) are billed monthly in advance through Stripe and renew automatically until you cancel. Current prices are shown on the pricing page and at checkout. We may change prices; we will give you notice before a change applies to a renewal, and you can cancel before it takes effect.
Prices exclude taxes unless stated otherwise. Where we are required to collect sales tax, VAT or similar, it may be added to your charge.
Failed payments. If a renewal payment fails, your subscription enters a past-due state and access to paid features is limited until the payment method is fixed. If it is not fixed, the subscription may be cancelled and the account moves to Starter with your data kept.
Refunds are handled under our Refund Policy. We never store your card number; Stripe handles payment details.
5.Cancellation
You can cancel a paid plan at any time from Settings, which opens the Stripe customer portal. Cancellation stops future renewals; you keep paid access until the end of the period you have already paid for. After that your account moves to Starter and your journal, trades, accounts and other data stay in place, subject to Starter’s limits.
6.Broker connections
Some features connect to your broker or prop-firm account using credentials you supply. By adding a connection you authorise us to use those credentials to log in to your broker on your behalf, sync your account and trade data, receive market data you are entitled to, and (where enabled) route orders. We store broker passwords encrypted at rest and use them only for this purpose.
- You must have the right to use those credentials and to connect third-party software to that account.
- You remain bound by your broker’s and prop firm’s own terms, rules and fees. Using PassTraq does not change those rules and we do not enforce them for you.
- We may pause, rate-limit or disconnect a broker connection when needed to protect the Service, your account, or the upstream provider, or when the connection is failing.
- You can remove a connection at any time from the account manager in the workbench.
7.Live order routing (Quant, beta)
On the Quant plan the workbench can send real orders to your broker account. Live routing is a beta feature. It requires an active Quant subscription and an explicit in-app live-trading acknowledgement, which you must accept before the first live order and again whenever its text is updated. Simulated (paper) execution is available on all paid plans and never reaches your broker.
If you enable live routing you agree that:
- you are responsible for every order sent from your account, including orders placed by mistake, by automation, or by someone using your device;
- you will keep risk controls in place on the broker side (position limits, daily loss limits, kill switches) and not rely on PassTraq as your only safeguard;
- software defects, network problems, broker or exchange outages and disconnects can cause orders to be placed, modified, duplicated, delayed, filled at unexpected prices, or fail to be cancelled;
- you will check your broker’s own platform or statements to confirm your true positions and orders whenever there is any doubt;
- we may disable live routing for your account or for everyone at any time, with or without notice, to protect users or the Service.

8.Market data
PassTraq does not sell market data. Live and historical data reaches you through the market-data entitlement you hold with your own broker or data provider. You are responsible for holding a valid entitlement and for complying with the exchange and vendor agreements that come with it.
- Market data, and the historical archive we keep, is for your personal use inside the Service only.
- You may not redistribute, resell, publish, scrape, bulk-download or otherwise extract market data or archive data, whether by hand or with automated tools.
- Data is provided on a best-effort, as-is basis. It may be delayed, incomplete or unavailable, and gaps and outages happen. We show only what the provider sends: a chart that stops moving in a quiet market or during an outage is not filled with invented ticks.
9.AI features (Finia)
Finia and other AI features generate text and analysis with a large language model from your trades, journal entries and the questions you ask. To do that, the relevant text is sent to our AI provider for processing (see the Privacy Policy).
- AI output can be wrong, incomplete or out of date. Check it before acting on it.
- AI output is not investment, financial, tax or legal advice and is not a recommendation to trade any instrument.
- Do not paste passwords, API keys, card numbers or other secrets into AI chats.
- You are responsible for how you use AI output. We do not guarantee any trading outcome from following it.
10.Your content
You own the content you put into the Service: trades, journal entries, notes, screenshots, playbooks, strategies, AI conversations and profile details (“Your Content”). You confirm you have the right to upload it.
You grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, analyse, display and transmit Your Content as needed to run, secure and improve the Service and to provide it to you and to people you choose to share it with. This licence ends when you delete the content or your account, except for copies in backups for a limited time and anything you have already made public.
Public profile and leaderboard are off by default. If you turn them on, the stats you choose to publish become visible to anyone; dollar amounts are not shown. You can turn them off again at any time.
Mentor spaces give read access to the people you invite. Invite only people you trust and remove access when it is no longer needed. We are not responsible for what an invited person does with what they see.
11.Acceptable use
You agree not to:
- use the Service for anything unlawful or in breach of your broker, prop-firm, exchange or data-vendor agreements;
- reverse engineer, decompile or try to extract the source of the Service, except where the law allows it regardless of this clause;
- run automated scraping, crawling or bulk export against the Service, its APIs, the market-data spine or the historical archive;
- resell, sublicense, rent or share access to the Service, or share one account between several people;
- circumvent plan limits, entitlement checks, rate limits or security controls;
- interfere with the market-data spine, the order-management gateway or any other part of the Service, or put an unreasonable load on them;
- upload malware, or content that is unlawful, infringing, or that you do not have the right to share;
- impersonate anyone or misrepresent your relationship with anyone on a public profile or in a mentor space.
We may investigate suspected breaches and suspend or terminate accounts involved.
12.Our intellectual property
The Service, including its software, design, text, graphics, models, and the PassTraq name and logo, belongs to us or our licensors and is protected by copyright, trademark and other laws. We grant you a limited, revocable, non-transferable right to use the Service under these Terms. Nothing here transfers any ownership to you. Feedback you send us may be used without obligation to you.
13.Beta features and availability
Features labelled beta (including live order routing, the code editor and the workbench on some plans) are still being developed. They may be less reliable, may change without notice, and may be withdrawn.
We aim to keep the Service running but do not offer a service-level agreement or uptime guarantee. The Service may be unavailable during maintenance, upgrades, provider outages, or events outside our control. We may change, suspend or discontinue any feature or plan; if we discontinue a paid feature you rely on we will try to give reasonable notice.
14.Disclaimers
PassTraq is software, not a broker or adviser. We are not a futures commission merchant, introducing broker, commodity trading advisor, registered investment adviser or exchange member. Nothing in the Service, including analytics, rule tracking, AI output, backtests, strategies, leaderboards or mentor content, is investment advice or a recommendation to buy or sell anything.
We do not guarantee that you will pass any challenge, keep a funded account, receive a payout or make a profit. Futures trading carries a substantial risk of loss and is not suitable for everyone. Read the Risk Disclosure.
To the fullest extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, and non-infringement. Rule tracking depends on the data you and your broker supply and on our understanding of each firm’s rules, which can change; your firm’s own figures always govern.
15.Limitation of liability
To the extent permitted by law:
- we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost trading opportunities, trading losses, lost data, or the loss of a challenge or funded account, however caused;
- our total liability for all claims relating to the Service in any 12-month period is limited to the fees you paid us in the 12 months before the event giving rise to the claim (or, if you paid nothing, to zero).
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing in these Terms excludes liability that cannot be excluded by law.
16.Indemnity
You will defend and hold us harmless from claims, losses and reasonable costs (including legal fees) arising from Your Content, your use of the Service, your breach of these Terms, or your breach of any broker, prop-firm, exchange or data-vendor agreement, except to the extent caused by our own breach of these Terms.
17.Termination
By you. You can stop using the Service at any time, cancel any paid plan in Settings, and ask us to delete your account by emailing [email protected]. Deletion removes your personal data except what we must keep for billing, legal or security reasons (see the Privacy Policy).
By us. We may suspend or terminate your account if you breach these Terms, if required by law or a provider, if your account is unpaid, or if the Service is discontinued. Where practical we will notify you and give you a window to export your data before it is deleted. On termination your right to use the Service ends; sections that by their nature should survive (including content licences for public content already published, disclaimers, limitation of liability, indemnity and governing law) do.
18.Changes to these Terms
We may update these Terms. The current version is always at passtraq.com/terms with its effective date. For material changes we will email the address on your account before they take effect. Continuing to use the Service after a change takes effect means you accept the new Terms; if you do not agree, stop using the Service and cancel your account. This version is effective August 15, 2026.
19.Governing law and disputes
These Terms are governed by the laws of the jurisdiction in which the operator is established, without regard to conflict-of-law rules.
If you have a problem, contact us first at [email protected] and we will try to resolve it informally within 30 days. If we cannot, either side may bring a claim in the courts having jurisdiction over the operator, unless the law where you live gives you the right to bring it elsewhere. If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a right is not a waiver of it. These Terms, together with the linked policies, are the whole agreement between you and us about the Service.
